Private Attorneys General Act (PAGA):
The Labor Code (PAGA) authorizes aggrieved employees to file lawsuits to recover civil penalties on behalf of themselves, other employees, and the State of California for Labor Code violations essentially acting as their own private attorney general. As employers navigate the increasingly complex minefield of labor law, it behooves them to be aware of their "cure" rights under the Act, new filing requirements, and possible exposure.

Dynamex Lawsuit: The California Supreme Court Restricts Use of Independent Contractors
The California Supreme Court's Dynamex v. Superior Court decision on April 30, 2018 was a game changer. Should workers be classified as either employees or independent contractors? The Court adopted a standard that presumes all workers are employees instead of contractors. The burden is now on any entity classifying an individual as an independent contractor to pass the new 'ABC' test.
