Government spending is up; tax revenues are down. IRS agents are working harder to collect what employers owe. Employers in the construction industry also have to worry about DOL stepping in to enforce overtime obligations that might not otherwise apply to an independent contractor. I-9, worker comp, insurance benefits, retirement liability – the list goes on. “Misclassification" can become enormously expensive. The entire concrete industry needs to understand the difference between employees and contractors. We will explore the different tests used by the government agencies, as well as the consequences of noncompliance.
